Tech Guru Acceptable Use Policy

TechGuru Acceptable Use Policy (‘AUP’) describes the proper conduct and prohibited use of TechGuru Hosting Services (‘Services’). Acceptable Use Policy (‘AUP’) is not comprehensive and TechGuru retains the right to change this AUP at any time, effective upon publishing the updated AUP at www. TechGuru.host. By applying for and using the Facilities and thereby agreeing the terms and conditions of this AUP, you intend to comply with these terms and conditions as amended from time to time. Any breach of the AUP may result in the suspension or termination of your account or some other action that TechGuru considers necessary.

Misuse of the Server

It is strictly forbidden to damage or disrupt a TechGuru server or client.

TechGuru responds negatively to the use or attempted usage of an internet domain or the device, without the owner’s authorisation, through unlawful usage of accounts or devices of others. These attempts include “online scamming” (triggering others to reveal their passwords), theft of passwords, scanning of security space, etc.

Any improper use of a TechGuru customer’s accounts or computers, whether TechGuru is a TechGuru attacker or not, would result in attacking the attacker. Measures can include, in connexion with a serious assault, alerts, termination or cancellation of accounts, and civil or criminal prosecution.

Significant NOTE – TechGuru has the power to terminate the operation of any user who violates our Politics or conditions WITHOUT Notification OR Advance NOTICE. No refunds or costs charged are made if the termination of the account has been triggered by the violations of these terms and conditions.

Customers can not run any shared server with IRC, bots or clients. Inappropriate uses include: e-mailing in bulk quantities, unsolicited e-mail, spamming newsgroups, pornographic material, unauthorised content, copyright infringements, trademark breaches, warez, crack, serial apps and/or something other that TechGuru considers it inappropriate, including misuse of server services.

Scripts via CGI

Every Linux shared web hosting account has its own CGI-Bin in which any * CGI scripts that you choose to use are available for free.

Erotica Pornography

Our child pornographic programme is null and void. TechGuru shall completely comply with any judicial enquiry into a customer’s violating child pornography statute of 1984. Ultimately, consumers are accountable for their customers’ behaviour over TechGuru’s network and are accountable for unauthorised content shared by their customers.

In accordance with the Child Protection Act, pornography of children comprises photographs, films, videos or any other visual presentations which indicate a person under 18 years of age who is engaged in or is identified as engaged in explicit sexual activity, or the dominant feature of which is the depiction of a sexual organ or anal r, for sexual purposes.

Child Protection Act breaches can be reported to the United States. 1-800-BEALERT Customs Department

Chat Rooms for Conversation

Without the consent of the TechGuru Support Team we will not allow customers to instal their own chat rooms in a shared hosting account. Most chat rooms are typically major machine hogs, and we can not permit this as an alternative.

Software for Continuous Processing

We do not encourage programmes to run in the background continuously. Some background programmes are memory and CPU-intensive, and hence we can’t run them on a common hosting server. We may recommend a dedicated server or VPS if your application requires any context program(s) to run.

Internet relay chat (IRC)

We do not allow the service on any of our servers of Internet relay chat (IRC) clients or IRC bots. Moreover, IRC servers on our network are not supported. Anyone who has discovered that this programme is in breach of danger automatically terminating the account.

Web Proxy

Applications for web proxies are banned. This comprises any script, such as a nph-proxy, that allows anyone from any server in the TechGuru network to browse a third party website or masks the true source of browsing activities using the TechGuru-related network details. As detected, those files are removed. Repeated failures lead to the withdrawal or deletion of accounts.

Gaming Servers

TechGuru does not allow gaming servers (not limited to Minecraft, Counter-Strike, Half-Life, battlefield1492) on its infrastructure as gaming servers are vulnerable to Distributed Denial of Service ( DDoS) attacks.

Downloads of Apps - Software

No applications can be saved for download on your website. The website provides room for storing web stores with documents specific to this website such as the SQL databases, GIF, SWF, ASP / ASP.NET / PHP / Perl, GIF and Jpeg Photos. It is strictly forbidden that anyone download software (third-party or own) from the web because it uses a lot of excessive bandwidth, thus hogging the server ‘s capacity. Infringement of this law will, without advance warning, result in automatic suspension or termination of services. The programme downloads of files with extensions such as.exe and.msI are permissible in standard hosting. Infringement of this law will, without advance warning, result in automatic cessation or termination of services.

Streaming of Audio / Video

We do not support streaming Audio / Video on the standard hosting servers because the CPU and bandwidth are hogged. This breached case is alerted by our Content Verification Team and is granted 3 days to back up the files. Tech Guru retains the right to terminate all accounts that include audios, radio, and videos (AVI, MPG, MPEG, MOV, MP3, PODCAST, etc). If the condition continues in the span of time, the files are destroyed. We consider Cloud or Audio / Video Streaming dedicated servers. However, you should post and instal videos on you, but the embedded videos do not infringe copyrights.

Downloads of Apps - Software

We do not support streaming Audio / Video on the standard hosting servers because the CPU and bandwidth are hogged. This breached case is alerted by our Content Verification Team and is granted 3 days for back up the files. Tech Guru retains the right to terminate all accounts that include audios, radio, and videos (AVI, MPG, MPEG, MOV, MP3, PODCAST, etc). Excessive Use/Overages

The bandwidth, storage and e-mail access limitations of your web-hosting contract will not be surpassed. TechGuru which, in its sole judgement, rates you with additional charges when you use some bandwidth or storage capacity above the accepted amount of megabytes / gigabytes a month. TechGuru shall not refund any unused pre-payments until it decides to take corrective actions. It is your duty to use your password to use it. You are responsible for any unauthorised access to your account that exceeds the restriction mentioned in your particular package requirements for web hosting and resulting costs by bandwidth, storage, and/or e-mail use. At $10 / GB / month or Rs 750 / GB / month, bandwidth overages are usually charged. You must update the kit to the next appropriate contract for storage space overages.

Heavy Database Size

TechGuru shared hosting size of databases is limited, as the maximum capacity for databases is 500 MB, and 1 GB is the log files cap for MS SQL databases. For WordPress hosting the default storage capacity is 1 GB. It is advised that you go for the cloud or dedicated server in larger datasets. TechGuru retains the freedom to reject funding for massive database transactions.

INODES

If there is no future termination, it could lead to more than 250,000 inodes in every Linux shared hosting account or to over 250,000 files / folders in the Windows shared hosting account being used. In order to prevent overuse, accounts which reach the cap of 100 000 inodes/ files will automatically be deleted from our backup system, but databases will still continue to be supported. Each file on your account is inode-free, including a website, image file, e-mail, and so on. Sites that marginally exceed our inode thresholds are not expected to be removed but accounts with hundreds of thousands of files or disruption to the file system will be flagged for investigation and/or suspension, continuously generating and deleting massive volumes of files. No more than 2500 immediate child files are available in every Subdirectory and no more than 10 GB of the overall data. When detected, the excess data need to be erased or moved to a new archive account. The key explanation for excessive inodes seems to be that users leave their call address available, but never search their mailbox for the primary account. Over time, tens of thousands (or more) posts are made up and the account will finally reach our inode boundary. Login in to cPanel, pick “Mail,” “Email Address,” “Get Email Address” and enter::fail: No user here, to deactivate the Current mailbox.

Platinum Plan & Platinum Plus Plan

Platinum Plan & Platinum Plus Plan can not be used for reselling the customers’ web hosting. Under Platinum Plus Package & Business Plan you can host only your own company websites. You can look for a reseller hosting contract if you intend to resell services to your clients. A violation of the agreement leads to your hosting service being terminated.

Bulk Emailing

It is specifically illegal to send bulk emails from the following email providers. Can’t send more than that;
Shared Hosting – 500 emails per domain per hour and 100 emails per user per hour
Biz Mail – 500 emails per email id per day
Business Email – 500 emails per email id per day
Enterprise Email – 10,000 emails per email id per day
G-suite – 2000 emails per email id per day
Office 365 – 10,000 per email id per day

Unlimited Defined

No custom-scripts / services support for third parties

TechGuru offers technological assistance supporting only our field of expertise. It requires assistance, troubleshooting, testing and other hosting-related problems of our panel interfaces such as cpanels & hosting controllers. TechGuru does not, however, have to assist YOU in downloading new framework modules, templates and/or languages and in supporting any bug created in applications that have previously been changed by you. We provide help to ensure that all free applications installed through Fantastico are installed in the configuration of the Cpanel control panel. TechGuru can only support modifying the customer application’s code to fix a problem and is subject to a customer arrangement that requires developers from TechGuru to access the code. TechGuru won’t change code explicitly, but will give the customer feedback to modify the code properly. TechGuru shall not be responsible for any lack of feature resulting from code changes in the programme. For consumer testing apps, TechGuru charges the rs. 1,500/- an hour. TechGuru also has no technical assistance from third parties for the direct clients of resellers. Reseller customers can directly contact the Reseller.

Data Backup

In preparation for data to be recovered in the event of a tragedy from the backup, TechGuru routinely takes every day copies of all websites and applications from all shared hosting servers. TechGuru claims, however, that its users retain and periodically refresh a local copy of their web information and databases. The fault of the backup or the specific data on the backup can not be checked out by TechGuru. The loss of the backup can not be blamed for TechGuru. TechGuru will have copies of Rs. 1.500/- plus a GST support tax for consumers upon request.

No-Spam Policy

We are Zero-Tolerance for spamming and do not permit spamming from our website or network. A spam report would lead first to a 24 hour warning and if spamming is not stopped, the accounts will be suspended. Owing to repeated spam reports, TechGuru retains the right to permanently terminate hosting of a domain without warning and no refund is made. Hosting the pages spamvertised will result with / without warning in an imminent end.

Overlap with IP Address

TechGuru operates a network of customer servers. The consumer can not use IP addresses that TechGuru workers have not given to them. Each domain that has not been explicitly allocated using IPs is suspended until IP address overlap can be resolved.

Material and Product Requirements

You should make sure that all materials and data put on the equipment of TechGuru are “server-ready” in a manner that does not enable TechGuru to modify more. TechGuru makes no attempt to verify the quality , accuracy or accessibility of any of this information. TechGuru will refuse this material if your material isn’t “server-ready.” TechGuru can convey the denial of material and encourage you to change material to meet the specifications of TechGuru. A certain level of expertise in internet languages, protocols and applications is necessary for the use of the Services. This degree of expertise varies according to the website’s intended use and preferred content. To build and manage a website, you need the information required. This expertise or customer care does not come from TechGuru outside the Facilities.

Intellectual Property Rights

Materials open to you by the services of TechGuru could be protected by U.S. copyright law or patent, corporate confidentiality, or privacy security legislation. Except specifically allowed by the rights of the owner of the TechGuru or the TechGuru servers and network, you shall not use any materials you view or obtain on the TechGuru Network to infringe, breach, dilute or misappropriate any other rights. You may not use this domain name in breach of any third-party trademark, business mark, and other similar rights if you use a domain name in association with TechGuru other related services.

Network Security

While trying to escape user authentication or protection in any server, Internet or accounts, consumers may not use the TechGuru network. This applies, but is not limited to, access to data that is not for the client, accessing a website or a customer’s account, authentication compromise, vulnerability checking of the infrastructure of other networks or abuse of the compliance policy by another organisation. Clients can not try to communicate with or refuse another user, host or network service. This involves earthquakes, postal bombs or other uses of overloading or crippling a server or network. These include but are not limited to. TechGuru shall collaborate entirely to prosecute device infringements or network protection on other platforms, including collaboration on reporting alleged criminal infringements with law enforcement authorities. Judicial or civil responsibility can be borne by consumers who breach the device or network protection. You are entirely responsible for all security abuses under your own jurisdiction on websites or accounts. TechGuru shall automatically shut it down whether the computer or platform is responsible for or participated in an intrusion or unwanted access to another server or device. You are charged for the cost of correct security violations which affect TechGuru or any other client.

Electronic Commerce

You shall be solely responsible for the production, operation and maintenance of your online shop and goods, including without limitation (a) the accuracy and appropriateness of content and materials in the store or relating to your goods and all the contents and materials that are displayed online, including (a) the true and applicable content and material in connexion with them; The final calculation and payment of shipping and sales tax shall be the sole responsibility of you. You shall also be strictly liable for the receipt, delivery and execution of all customer requests and the management of customer questions or grievances. You are also responsible for the protection of all credit card numbers and relevant customer details that you have access to via your website as part of electronic business transactions. You will retain all of this secrecy and use the sensitive information with much care and protection as you do it.

Static / Dynamic Content Caching

You expressly I authorize the TechGuru website as a whole to cache the content offered by third parties, hosted under this Arrangement by TechGuru, and (ii) accept that the cache is no violation of any of your rights to intellectual property or the intellectual property rights of any third party.

IP Address Ownership

TechGuru shall, under the absolute discretion of TechGuru and TechGuru, retain and manage the property of all IP numbers and addresses which are allocated to you by TechGuru and TechGuru reserves.

Lawful Purpose

TechGuru maintains the freedom to deny another person’s service. Only for legal reasons can customers use TechGuru server. In violation of federal, state or municipal laws, the transfer of any content is banned. This does not cover content lawfully considered to be offensive or obscene and content covered by trade secrets that is not limited to copyright-controlled material. TechGuru management has the absolute right to select the products as mentioned above. Wherever this document may be concluded, the client consents to the contract being entered into and executed in Mumbai , India for the purposes of the location and jurisdiction and to any conflict being settled or dispute resolution in Bombay , India. The consumer also waives all challenges or authority to Mumbai Court and agrees that Mumbai Court is to retain venue and authority in all other proceedings. IN NO EVENT SHALL TECHGURU’S MAXIMUM LIABILITY EXCEED FIVE HUNDRED ($500.00) DOLLARS.

Payment Policies

All accounts are prepared in advance. Installation fees are charged and are not reimbursed for all new accounts and major account changes. For the pre-paid period, all pricing is guaranteed. Unless other terms and conditions have been agreed, TechGuru reserves the right to change prices at any time. Credit card accounts can be compromised by the issuer for transactions declining, within 48 hours of notice via email. Any account which has not been updated within a week (7 days) of email notification or which in any way extends this period shall be disabled by full account. The customer is responsible for all money owing to the account, from the time that it was created that the customer tells TechGuru of the order for termination of services by eMail at billing@techguru.host. TechGuru shall charge each customer, depending on the branch, Rs.100/- at Rs.150/-. Both accounts are formed on billing periods for anniversaries. The contract period selected initially on set-up refers to the basic billing duration. Customers shall pay all fees, rates and municipal costs for the facilities given below (except TechGuru’s income taxes). For the cost of the Web hosting facilities and the payments associated with your account, TechGuru welcomes paper checks from clients.

Cancellation

TechGuru reserves the right at all times to terminate the service. If TechGuru retains the right to cancel, all payments charged in advance would be pro-rata and compensated by TechGuru. Cancelation refunds can then be made via corporate control or credited to the credit card within 30 days of receipt of the cancellation, whichevery breach of policy leads to the increased costs will be billed to the consumer (i.e. transfer, space, etc.). Cancelations can only be accepted from 9:30 a.m. – 18:30 h. Monday-Saturday IST. IST. On holiday or on weekends no cancellations are processed.

Liability and Obligations on Cancellation

If the Arrangement is terminated or cancelled, TechGuru shall not be liable to you for the termination of payments, repayment or losses incurred by loss of forward-looking sales, anticipated selling, goodwill or expense, savings, rents or responsibilities in connexion with your company, or for any other reason resulting from the expiration or cancellation of the Arrangement. When this Arrangement is discontinued, TechGuru will not discharge you of your commitments to pay payments or penalties that you owe to TechGuru under this Arrangement previous to the termination date or any any numbers.

COMPENSATION

CUSTOMER AGREES THAT IT SHALL DEFEND, INDEMNIFY, SAVE AND HOLD TECHGURU HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATTORNEY’S FEES ASSERTED AGAINST TECHGURU, ITS AGENTS, ITS CUSTOMERS, OFFICERS AND EMPLOYEES, THAT MAY ARISE OR RESULT FROM ANY SERVICE PROVIDED OR PERFORMED OR AGREED TO BE PERFORMED OR ANY PRODUCT SOLD BY CUSTOMER, IT’S AGENTS, EMPLOYEES OR ASSIGNS. CUSTOMER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS TECHGURU AGAINST LIABILITIES ARISING OUT OF;

DISCLAIMER

TECHGURU WILL NOT BE RESPONSIBLE FOR ANY DAMAGES YOUR BUSINESS MAY SUFFER. TECHGURU MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED FOR SERVICES WE PROVIDE. TECHGURU DISCLAIMS ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY TECHGURU.HOST AND ITS EMPLOYEES. TECHGURU RESERVES THE RIGHT TO REVISE ITS POLICIES AT ANY TIME. ALL SUB-NETWORKS, RESELLERS AND DEDICATED SERVERS OF TECHGURU.HOST MUST ADHERE TO THE ABOVE POLICIES. FAILURE TO FOLLOW ANY TERM OR CONDITION WILL BE GROUNDS FOR IMMEDIATE ACCOUNT DEACTIVATION.
